What if the Election Fails?
- Maggie Pond is an un-decreed and illegal pond under Colorado water law. Thus, the State could demand removal.
- Maggie Pond does not hold any water rights; mud flat and dry pond bed becomes a likelihood. It will require a lot of work to restore.
- The pond currently has 2-3 feet of sediment, dangerous for anyone or an animal falling through the ice.
- The Maggie Dam is failing and requires repair.
- Options to replace the failed pond involves difficult and lengthy processes, at great expense, requiring permanent and long-term accounting for reservoir operations.
- No cost sharing agreement.
- No liability transfer to a governmental entity; liability remains with all private ownership groups.
